SIX POPULISMS

TPMCafe’s guest stint by Thomas Frank (One Market Under God, by the way, is a masterpiece) has stirred a spirited debate about the place of populism in a progressive future. Populism is a word which has rightly come up fairly frequently in more- and less-enlightened discussions of the left’s future, but too often it seems like folks are talking past each other. Here are six of the somewhat but not entirely related themes I think are in play in the way different people discuss populism:

Progressive Economics: In broad strokes, the economic policy proposals that get labeled as populist are the ones least popular with the Washington Post editorial board and the “Washington Consensus” crowd: fair trade or no trade; downward economic redistribution; unionization. Opposition to immigration often gets grouped in here as well as part of the same package, though for obvious reasons I’d rather apply the populist label to the push for equal labor rights for immigrants.

Direct Democracy: The other set of policy proposals which usually get the populist labels are the ones which bring political decisions under more direct control of the American public. This includes taking decisions away from judges and handing them over to legislatures and taking them away from legislatures and handing them over to public referenda.

Trust in crowds: Populism is also used to describe a posture – whether held by politicians or activists – of trust in the mass public and distrust in elites. Usually, trust in the public is justified by an appeal to the wisdom of common people in identifying their own problems and synthesizing their own solutions. And distrust in elites is justified on the grounds of their inability to understand those insights or, more often, their narrow interests.

Democratic Legitimacy: Populism also describes a particular kind of appeal made by elected or unelected political leaders. Candidates for office, especially, tend to get the populist label for seizing democratic legitimacy for themselves – that is, for framing themselves as the bearers and protectors of the people’s will. The corollary to the candidate as representative of the masses is the candidate as enemy of the elites, whose hostility is easily explained by their opposition to the popular policies and popular mandate.

Prejudice: Populism is also a frequently-invoked label to describe all manner of ugly prejudice, be it directed against Blacks, Jews, homosexuals, or immigrants. In this conception, populism is the cry of some self-defined majority against unwelcome interlopers. This meaning of populism – which gives elites a lot of credit – is never far when someone’s looking to discredit one of the others.

Economic Focus: Maybe the simplest sense in which the word populism is used is to refer to a focus on economic issues (rather than a particular stance on them), to the exclusion of others.

That makes two kinds of policy approaches, two rhetorical/ philosophical postures, a question of focus, and a very bad thing (generally thrown into the mix by pundits like Joe Klein to make everything associated with the word sound ugly). Each of them, though, has a way of showing up implicitly in discussions about what is or should be populist.

What does it mean, for example, to ask whether Bill Clinton was a populist President? He often gets described that way, in large part because he ran on the economy (“It’s the Economy, Stupid”), and because his challenge to Bush benefited significantly from a sense that Clinton represented the concerns of the American people with which the President had fallen out of touch (and supermarket ray-guns). Others associate Clinton with the decline of populism in the Democratic party, and of the party in the country, pointing to his conservative stance on issues like NAFTA and the technocratic underpinnings of the “Reinventing Government” concept. I’m not going to say they’re both right (I’d say Clinton campaigned as a populist, but he didn’t govern as much of one). I will say that on those terms, it’s no surprise that those conversations don’t get farther than they do.

Thoughts?

AN ECHO, NOT A CHOICE

Faced with the the real possibility of a rejection of the Central American Free Trade Agreement (CAFTA) in the House, which would mark a significant defeat for George Bush and for the already-cracking “Washington Consensus” on free trade, the Democratic Leadership Council has stepped up to bat in CAFTA’s defense. As David Sirota writes:

As if the DLC is just an arm of the Bush White House, the organization timed this release perfectly to coincide with Bush’s final push for the legislation, as if they are just an arm of the Bush White House. Despite the DLC’s pathetic, transparent rhetoric about wanting to “bring a spirit of radical pragmatism” to the debate, what the DLC is showing is that it is an organization devoted to urging Democrats to sell their souls to the highest bidder. That may sell well with the DLC’s corporate funders in Washington, D.C., but out here in the heartland, that kind of gutless behavior only hurts the Democratic Party over the long run.

Sirota drew some fire from DLC folks after the election for a piece he wrote arguing that the version of “centrism” they promote is well to the right of the average American and thus not only morally but also electorally bankrupt. I’m even less interested now than I was then in trying to evaluate the claims and counter-claims which flew in the wake of the article about which politicians, or talking points have or haven’t gotten gotten the DLC’s approval at what times. As I said at the time, if the DLC wants on board with Elliot Spitzer’s prosecutions of CEOs or Howard Dean’s condemnations of GOP corruption, the more the merrier. We need all hands on deck, and the work is too important to let historical differences avert cooperation where there’s consensus.

About those historical differences though: There’s a constellation of consultants who see class-conscious economic populism as roughly equivalent to racism, see “big government” as a menace to be tamed by technocrats irregardless of the will of the governed, and see the salvation of the Democratic party in policies which fulfill CEOs’ wishlists in the name of liberating their employees. And they have exerted massive, and unfortunate, influence over the direction of the Democratic party over the two decades since their founding, particularly the eight years of the Clinton Presidency. At least for those years, the major proponents of that “business-friendly,” “free-trading” ideological position with the Democratic party, as they themselves would tell you, were the Democratic Leadership Council as an organization and its affiliated thinkers. As Thomas Frank in What’s the Matter With Kansas?, Thomas Geoghegan in Which Side Are You On?, and even self-described “radical centrist” Michael Lind in Up From Conservatism (on DLC: “an echo, not a choice”) demonstrate, the consequences included ceding the support of all too many working class voters and the control of the US Congress.

I’d be the first to acknowledge that there’s a tendency amongst some of us on the left to throw around the term “DLC” liberally (so to speak) in reference to an ideological position we disagree with rather than to the organization itself, at times even in describing policies the DLC, as an existent think tank and not a symbolic construction, may not fully support (they were indeed in favor of weakening class action lawsuits, but I’m still waiting to know what they make of Bush’s bankruptcy bill). I’d like nothing more than to be convinced never to use the acronym that way again – it’s not hard to come up with other epithets for Democrats who vote for Corporate America’s interests over everyone else’s. But there’s a reason that so many of us associate the DLC, judiciously or not, with corporate courtship and not with, say, crusades against corruption. It’s epitomized, sadly, by the choice to come out swinging for a trade agreement even “dogmatic free trader” Matt Yglesias recognizes as “an effort to impose low labor standards and a misguided intellectual property regime on Central American nations.”

WAL-MART VERSUS THE DISABLED

It’s not just folks who care about workers’ rights, women’s rights, racial equality, environmental stewardship, fair trade, free speech, or responsible development who have issues with Wal-Mart. The world’s largest retailer is also bad news for those of us who believe in the Americans with Disabilities Act. As this Daily Kos diary reminds us, the company was ordered in Feburary to pay 7.5 million dollars in damages to Patrick Murphy for reassigning him based on his disability. Now the New York Law Journal reports that the judge has cut the damages by $4.7 million to reflect the $300,000 cap on punitive damages under federal law. Judge Orenstein observed that within the limits of the law, it’s impossible to charge Wal-Mart enough to actually have the deterrent effect that punitive damages are supposed to:

“The preceding ruling respects the law,” Orenstein wrote, “but it does not achieve a just result.”…”There is no meaningful sense in which such an award can be considered punishment,” Orenstein wrote, pointing out that Wal-Mart had $300,000 in sales every 37 seconds last year…Orenstein said that Wal-Mart would not be deterred by the amount of punitive damages. He found that in dealing with Brady, the company had not adhered to a consent decree it entered into with the Equal Employment Opportunity Commission in 2001 requiring it to train managers and change hiring practices. “The most generous conclusion I could draw … was that the Wal-Mart employees who testified are well-intentioned people whom the company willfully failed to provide with sufficient training to abide by the anti-discrimination law,” Orenstein wrote. “The result,” he concluded, “was that Brady was subjected to the kind of discrimination against the disabled that both the law and the prior consent decree was designed to prevent.” The $300,000 punitive cap, he held, “appears unlikely … to restrain Wal-Mart from inflicting similar abuses on those who may be doomed to follow in Brady’s footsteps.”

Next time you hear someone arguing that arbitrary caps on the freedom of juries to assign punitive damages will protect the little guy against hordes of greedy trial lawyers, remember Patrick Murphy. And remember whoever becomes the next victim after Wal-Mart concludes once more that in the long run, discrimination is cheaper than equal opportunity.

SEEKING SOLAR SOLIDARITY

Nathan offers a good example of what a missed chance to build a broad-based pro-environmental constituency looks like:

California is debating a Schwarzenegger-backed bill to subsidize solar panels on homes and businesses across the state– on a level that could supply energy equivalent to 10 average-sized coal-fired power plants. Sounds good, but in a classic move to pit labor and environmental interests, the GOP cosponsors, as this article details, oppose a requirement that public money only go to installers paying prevailing union wages in the state. Labor in California has fought a long struggle to require that, if government pays for it, the labor has to meet union wage levels. Now, the GOP wants to open a multi-billion dollar loophole in the rule: somehow the hipness of solar panels makes using public money for sweatshop labor acceptable. This is a perfect chance for environmentalists to stand up for the principle that green policy can also be a pro-labor policy, but few environmental leaders have stepped up to champion prevailing wages for the workers who would actually install all these solar panels across the state.

It’s this kind of failure build not just a momentary majority but a stable, inter-generational, cross-cause constituency that caused some environmental leaders last year to declare “The Death of Envionmentalism.” Of course, where Nathan says,

And the enviros wonder why some labor unions joined the GOP in supporting drilling in ANWR when they promised that all those jobs would pay union wages

one could with equal justification fire back “And the union people wonder why some environmentalists are willing to screw them to get solar energy in the wake of ANWR.” The stakes for both movements – fostering an alternative to a laissez-faire race to the bottom and building an economy which values and invests in human beings and the earth – are too high not to work together. Everyone has on the left has some work to do to get their own house(s) in order. Tuesday night several groups at Yale sponsored an excellent debate between the Reverends Barry Lynn (of Americans United for Separation of Church and State) and Jim Wallis (of Sojourners Magazine) on the role of faith in public life. They’re both thoughtful and articulate speakers with a stake in a more progressive turn for this country.

Wallis is frustratingly off-base in his support for President Bush’s Faith-Based Initiatives as an opportunity to be seized by a religious left. The issue, as I’ve said before and as Lynn argued, is not whether religiously-identified groups are eligible for government support when they provide social services but whether they will be subject to the same regulations as everyone else when they are. Lynn quoted troubling comments from Wallis conflating denying funding to groups because they hold a certain faith with denying funding to those groups because they discriminate in hiring against those who don’t. And Lynn rightfully questioned Wallis’ attempt in writing to dichotomize racial and religious discrimination, pointing out that for some of the groups in question one identitiy is mapped onto the other – and that right-wing churches led by the likes of Pat Robertson haven’t been rejected for “preaching hate” like the Nation of Islam has. Wallis, to his credit, expressed unspecified concerns with the implementation of the initiatives, but declined the engage the issue of discrimination and instead expressed hope that the Supreme Court would sort it out.

My sympathies were more divided between the Reverends on the other issue which consumed much of the debate: What is the place of religious rhetoric in political discourse? I share Rev. Lynn’s concern that the halls of Congress not be overtaken with arguments over the details of scriptural interpretation. He’s right to argue that in a pluralistic, democratic society votes should be cast, and should be explained, based on popular rather than divine authority, and on the basis of shared rather than sectarian values. He’s right to observe that while religious rhetoric infused the Civil Rights Movement through and through, when members of Congress cast their votes in 1964, they explained them through appeal in large part to the values of equal protection set forth in our common law. And he’s right to reject Wallis’ tenedency to reduce “values” to religion and to reduce the political spectrum to religious right versus religious left.

That said, I think few of us disagree with Rev. Wallis’ contention that it’s long past time that the religious left disrupted what he calls the monologue of the religious right. And I’m not persuaded by the bright lines Lynn seeks to draw between the discourse in the halls of Congress, in the church, on opinion pages, at rallies, and on Meet the Press. Certainly, an advocate assumes a different voice than a representative, speaking on different grounds and to a different audience. But Wallis is right that there should be a place for our elected representatives to speak to their personal faith convictions as well as to our shared democratic ideals. He’s right that for Lynn to bristle categorically at any instance of biblical references by elected politicians does little to further the cause of religious freedom.

One audience member asked Rev. Lynn why he was comfortable with Senators quoting from “anything else in Bartlett’s Quotations,” but not the Bible, and in response Lynn made an illuminating distinction between a quote to persuade – invoked because the quote itself makes a persuasive argument for whatever is being advocated – and a quote on the basis of authority, which is invoked to bring down the authority of whoever said the quote in the first place as an argument in and of itself for what’s being advocated. Lynn’s belief is that Bible quotes are always brought in not to share creative persuasive arguments but to shut down argument by virtue of biblical authority. I’m not so sure. It may be complicated to distinguish between appeals to a biblical argument and invocation of biblical authority, but I think it’s critical that we do. I think it’s similarly critical that we distinguish between those who invoke their particularistic faith values as ends unto themselves, and those who offer them as a personal path to our shared faith in community, in individual freedom, and in social justice.

Guest-blogging over at Ezra Klein’s site (mazal tov!), Dan Munz is suggesting the possibility of a Mfume v. Steele Maryland Senate race as a chance for Democrats to take on and shoot down the GOP argument that Democrats take Black voters for granted. I think Dan’s absolutely right that a concerted, rigorous response from the Democrats is long overdue. I’d say part of the problem, though, is that the Democratic party establishment does indeed take Black voters for granted, in much the same way it takes most chunks of the party’s base – union voters for example – for granted, and in a way the GOP simply doesn’t treat it’s own base. Wherever one comes down on the Katha Pollitt vs. Thomas Frank debate on whether or not evangelicals who vote Republican to erode reproductive choice get their money’s worth, the Republican party makes a serious, year-in and year-out campaign of selling itself to its base while the Democratic party more often treats its base like the weird uncle who always shows up drunk to Thanksgiving (the pundits who complain about how short-sighted the NAACP is for wanting Democrats to swing by when the NRA doesn’t ask the same of Republicans might spend their energies better considering why the parties’ records might leave NAACP members with more concerns about how loyal the candidates they vote for will be).

Granted, President Bush’s appeal to Black voters to better defend their interests by spreading their votes more evenly is pure condescending silliness (I’d like to see him apply the same logic to, say, Enron executives: “As long as you all keep voting for us, what incentive do we have to keep giving you those invisible handjobs?”). More fundamentally, of course, the problem with Bush’s case is the idea that Democrats brazenly push forward with liberal policies they know are bad for their Black constituents. The reality, unfortunately, is that Democrats tend not to do nearly enough brazenly pushing forward with much of anything. The problem isn’t that the Democrats are too far left; the problem (I know I know, I’m the guy with the hammer, and look – it’s another nail!) is that the Democrats are failing Black constituents, as well as White ones, by not offering a program or an approach that’s progressive enough. The Republicans are hard at work rolling back the gains of the Civil Rights Movement, while the Democrats, even when they had branches of government of work from, have shown precious little initiative in extending them. Republican national candidates have mastered the art of the coded appeal to racist voters, while Democratic candidates remain anxious about looking like they’re trying too hard to attract Black voters (or, god forbid, “dependent” on them).

What might an aggressive Civil Rights agenda look like? An aggressive push for comprehensive voting reform, including a constitutional individual right to vote, uniform standards for ballot access and machinery, paper trails, and abolition of felon voter disenfranchisement. An aggressive push to transform the crimminal justice system into one which takes seriously the equal protection rights of Americans of different races and classes and which rehabilitates rather than stigmatizing those who pass through it. An aggressive push for drastically increased investment in education at all levels. An aggressive push to raise the minimum wage and strengthen the right to organize. An aggressive push to strengthen anti-discrimination legislation. An aggressive push for universal health care. An aggressive push for real affordable housing. That would be a start. Some of these areas have attained greater prominence in the Democratic party’s agenda of late, to a lot of people’s credit; others are still waiting. As Dr. King observed not long before death, the reforms that will achieve real progress in Civil Rights will cost billions. All of these reforms are changes in which Americans of all races have a stake, and which could be achieved such that the great majority of Americans would benefit. And this summer in Florida, I had infinitely more conversations with African-Americans reluctant to register to vote because of the party’s silence or meekness on continuing the progressive work of the Civil Rights movement than because they wanted school vouchers or felt demeaned by affirmative action or were scared of gay people.

So yes, the Democrats need better answers to the Republicans’ cynical appeals to Black voters, and they need candidates who are better at articulating them. But any message which boils down to “No, Democrats don’t take [you/us] for granted, they care about [you/us] very much” is doomed to fail. What the Democrats need, as Al Sharpton put it several times during the Presidential debates, is candidates who can give the donkey the kick it needs (not something Sharpton accomplished a great deal at). And the most powerful kicks tend not to come from candidates at all. As much as Dan talks about a “traditional” relationship between Democrats and Black voters, the tradition is fundamentally one of tension and contestation, one which envelops both Jack Kennedy’s supportive call to Coretta Scott King and Bobby Kennedy’s call to John Lewis pleading him to cancel the freedom rides. As with so many other cases, the job facing the leaders of the Democratic party is as much about improving its record as defending it.

Kos loses it:

Once upon a time, party officials feared NARAL, they feared the unions, they feared the Sierra Club, they feared trial lawyers, they feared NOW, they feared the NAACP, they feared Latino groups, and so on. For the first time, it looks like they’re starting to fear people, not special interest groups. We’re growing up as a party.

Wal-Mart is a special interest because it leverages a tremendous amount of money and power to serve narrow ends which benefit a tiny constituency of plutocrats and wreak havoc on the lives of most Americans.

Unions pool and leverage the power of their members and their willingness to engage in organizing and collective action to secure justice for themselves and for millions of working Americans. There is no comparison.

To say that bevy (however large) of bloggers (folks who are disproportionately whiter, richer, and maler than America, let alone the Democratic party) are real people in a way that organized workers, organized environmentalists, organized women, and organized people of color are none is outrageous.

I’m frustrated to see Keith Gottschalk arguing that a poll suggesting troops in Iraq support the President is cause not to support the troops:

Taken all the above quotes into context it shows that truly we do cull the ordinary Americans from the heartland to serve in the military. No critical reasoning skills among the majority of this bunch, even when their own lives are being used as cannon fodder. In this they reflect the simple majority of Americans who have been dumbed down and trained not to think critically or question what they are told.

The poll itself is highly questionable, insofar as it draws only on subscribers to military magazines. And “Support the Troops” as a slogan is more often than not cynically manipulated by the same crowd defending Rumsfeld’s “Screw the Troops” approach. That said, whether our politics line up with those of the majority of the soldiers currently bearing the burden of the failed policies of much wealthier, safer politicians is an awful way to judge whether their needless death and suffering, like that of Iraqis, should trouble and pain us. Too often the left has made the mistake of blaming those in the working class carrying out policies when our animus should be directed at the rich bastards who are fashioning them. And deriding the poor as stupid is a terrible and offensive excuse which makes it that much easier to avoid confronting the organizing failures of the left, and in so doing perpetuates needless suffering and savage inequality.

Bad idea:

The leadership of the Human Rights Campaign, at a meeting last weekend in Las Vegas, concluded that the group must bow to political reality and moderate its message and its goals. One official said the group would consider supporting President Bush’s efforts to privatize Social Security partly in exchange for the right of gay partners to receive benefits under the program.

Talk about forgoing the big tent. The Human Rights Campaign has always been too conservative for me. But this would be a new low. First, because contrary to the impression one might get from Queer Eye for the Staight Guy, scores of queer folks and their families also depend on social security to enable them to retire with dignity rather than into poverty, and they too deserve better than this privatization sham. Second, because now more than ever, as the economic justice movement struggles to better do justice to its queer constituents, standing on the wrong side of one of the major economic justice debates of the next four years can only narrow the movement. Third, because social security privatization is also incredibly unpopular with the American public, as it should be. So if, as the article suggests, the HRC’s new focus is on introducing gay America to everybody else, this seems like a particularly ill-chosen move to start with. (Spotted by Julie Saltman)

Speaking of Social Security, some one should ask David Brooks whether he’d be comefortable staking his national security on the stock market. Because if not, he’s in a strange position to be telling working class Americans to entrust their economic security to it. There’s a reason we call it “Social Security,” not “Social Program In Which If You Play Your Cards Right You Have A Decent Shot Ending Up Less Poor Than Without It.”

Frequent readers (thanks, Dad) know that I’m an advocate of broad-based progressive moments as the only effective instrument of progressive change. In particular, I’ve used this space to argue that in support of moves within the labor movement towards a broader conception of what it means to sdvocate for the interests of workers, be it native and immigrant workers standing together in the Immigrant Worker Freedom Rides, partnership between healthcare workers and patients calling for universal coverage, or SEIU’s strong stance against the Federal Marriage Ammendment as an assault on the rights of its members. As was declared at the first union event I ever attended in New Haven, in response to President Levin’s intimations that Yale’s unions have a broader agenda, “You bet we have a broader agenda.” I’ve also criticized those movements locally and nationally when the broader agenda has proved not as broad as one would hope.

This is a debate that must take place in every progressive movement committed to winning over the next years. The environmentalist movement, as Randy Shaw argued compellingly in his Activist Handbook, is a prime example as well. Looks like former Sierra Club President Adam Werbach agrees:

For example, I’ve been trying to tell my friends at the Sierra Club that the most important battle for the Sierra Club and the next two years might be over public education. That is the battle line over collective activity, interdependence, the values we care about — much more so than the Arctic National Wildlife Refuge. That’s a skirmish along the way that’s not strategic. It’s way off to the side.

Via Ralph Taylor at Nathan’s site, who also points back to Ted Nordhaus and Michael Shellenberger’s “The Death of Environmentalism”:

The truth is that for the vast majority of Americans, the environment never makes it into their top ten list of things to worry about. Protecting the environment is indeed supported by a large majority — it’s just not supported very strongly. Once you understand this, it’s much easier to understand why it’s been so easy for anti-environmental interests to gut 30 years of environmental protections…Whereas neocons make proposals using their core values as a strategy for building a political majority, liberals, especially environmentalists, try to win on one issue at a time….The serial losses on Rio, Kyoto, CAFE, and McCain-Lieberman were not framed in ways that increase the environmental community’s power through each successive defeat. That’s because, when those proposals were crafted, environmentalists weren’t thinking about what we get out of each defeat. We were only thinking about what we get out of them if they succeed. It’s this mentality that must be overthrown if we are to craft proposals that generate the power we need to succeed at a legislative level.

…There is no better example of how environmental categories sabotage environmental politics than CAFE. When it was crafted in 1975, it was done so as a way to save the American auto industry, not to save the environment. That was the right framing then and has been the right framing ever since. Yet the environmental movement, in all of its literal-sclerosis, not only felt the need to brand CAFE as an “environmental” proposal, it failed to find a solution that also worked for industry and labor. By thinking only of their own narrowly defined interests, environmental groups don’t concern themselves with the needs of either unions or the industry. As a consequence, we miss major opportunities for alliance building. Consider the fact that the biggest threat to the American auto industry appears to have nothing to do with “the environment.” The high cost of health care for its retired employees is a big part of what hurts the competitiveness of American companies…Because Japan has national health care, its auto companies aren’t stuck with the bill for its retirees. And yet if you were to propose that environmental groups should have a strategy for lowering the costs of health care for the auto industry, perhaps in exchange for higher mileage standards, you’d likely be laughed out of the room, or scolded by your colleagues because, “Health care is not an environmental issue.”…Let’s go for the massive expansion of wind in the Midwest — make it part of the farm bill and not the energy bill. Let’s highlight the jobs and farmers behind it. But bring about this sea-change in the way the environmental movement thinks and operates isn’t going to be easy. For nearly every environmental leader we spoke to, the job creation benefits of things like retrofitting every home and building in America were, at best, afterthoughts.

We all have a lot of work to do.

This post has sparked some strong disagreement from Errol and Jamie. Errol writes:

Why shouldn’t that student or students like him be able to go to a school where he feels comfortable expressing his opinion on campus. This is a very widespread opinion because it’s almost uniformly ignored by liberals on college campuses around the nation. We simply ignore that while making our campuses an open forum for almost every liberal, progressive, leftist or whatever you want to call left of center opinions, that we impose an almost tyrannical speech code on our more conservative students. They’re not only often afraid of being relegated to being pariah by speaking their minds in class about what they might see as the negative effects of an encroaching welfare state, the evils of moral relativism, or the value of tradition in human interaction, but they must constantly be bombarded with propaganda with which they disagree. The implication of your post seems to be that conservative students or others that feel very much marginalized on college campuses should just suck it up. Why should they? Is it because they’re in the minority? Or is it because you have such a firm control over the truth or over what’s right and what’s wrong that you can suddenly feel comfortable excluding certain voices from discourse? Because ultimately that is what lost when people feel so uncomfortable, when people feel strongly enough about the social pressures that they feel to evoke “the Nazi button policies” as a way to explain to others the level of oppressiveness that they feel.

For sake of time, I’ll reprint here my response in the comments: I’m not clear on how it is, Errol, in your argument, that “an almost tyranical speech code” is imposed on “our more conservative students.” Is it simply by nature of disagreeing with these more conservative students that the majority is teetering on the edge of tyranny? What I labelled as immature in the piece I linked was the contention that merely being asked by peers to support a social cause that one disagrees with is oppressive. The natural end point of this argument, it seems to me, would be that no Yale Law student should ask for another Yale Law student to join a cause unless she knows that he already is aware of and supportive of it. That seems likely to translate into very few causes getting off the ground at a school which prides itself on – and attracts students through – its reputation for cultivating students concerned about their surrounding and national communities and prepared to use the law in support of social justice.

As someone who tends to come down pretty far on one side of the spectrum of opinion at Yale, I’ve often been in the position of being an ideological minority. But while I’ve certainly been critical of policies – like police seizure of leaflets in the Woolsey Rotunda – which restrict my expression of those views, I’ve never argued that my views are being stifled simply by not being widely shared. The past few years have provided endless chances to watch the same national and local figures relentlessly bemoan a “culture of victimhood” amongst historically marginalized groups while raising alarms over the supposed oppression of campus conservatives who are stuck, for example, having liberal commencement speakers. Few of them have gone so far as to compare solicitations to support a cause to Nazism.

We’re told that “there was very little opportunity to express alternative opinions at the law school,” but we get no account of any dissent that was stifled, or any attempt to express those alternative opinions. He offers no evidence that he tried to do so – or to identify himself as an intentionally “non-button wearing student” rather than someone who hadn’t had the chance to get one. Democracy is messy. Sometimes it involves being asked to do things one doesn’t want to. If he had said no and discovered as a result that his grades were being lowered or his posters were being torn down or, say, his door was being slammed with a 2 by 4, that would be more like persecution.

As for the enforcement of the non-discrimination policy, if you have evidence that it’s going unenforced in other cases, or questions about its parameters, there’s a phalanx of lawyers and futures lawyers on this campus much better equipped to respond.

And yes, Yale is an “oppressive” place to be if you’re a conservative, er, rather, not a leftist. I often have to ask myself if those who think not being a liberal at Yale is easy live on the same planet as I do. When I ask myself this question, the answer I always come up with is, no, these people do not live on this planet. And don’t even try to tell me that you’ve felt unfairly marginalized as part of the “ideological minority.” You haven’t. For people who use the word “Nazi” and “fascist” so freely to describe your political opponents, its clear that you’ve lost any and all ability you might have once had (which probably wasn’t all that much to write home about in the first place) to recognize literary devices like facetiousness or overstatement. To act as if being one of 90 people not to sign a petition that the other 500 of your professors and peers have deemed to be a moral necessity is an easy situation to live with flies in the face of reality.

Look, it’s never easy to disagree be surrounded by people who disagree with you, as generations of college students on various parts of the political spectrum on various campuses have discovered over the past several generations. Fortunately, many choose to speak up anyway. Hopefully, all of us are at college looking to encounter articulate advocates for positions we disagree with, and hopefully we’ve each been successful. Jamie’s quick to dismiss the claim that those of us to the left of the Yale center may also have it less than easy sometimes. I think it’s worth noting that the major instance of violent response to dissent while we’ve been on campus was targeted against a girl hanging an upside-down American flag. And I think it’s worth noting that it’s been students criticizing University policy from the left who’ve been stopped or detained by the police. To read some of Jamie’s earlier posts you’d think that left-wing critics of University policy represented a tiny fringe; to read ones like this you would think that the student body was a massive cohort of far-left radicals. I’d say the truth is somewhere in between.

To argue that Yale oppresses those to the right of the left simply rings hollow. For copies of Light and Truth to be confiscated by administrators back when because they suggested skipping sex-ed lectures was certainly outrageous, although I’m not fully persuaded that can be chalked up to left-wing bias rather than a generally spotty record on protecting dissent from administration policy. Of course, it’s usually been students on the left who’ve borne the brunt of Yale’s failures in this vein. On the other hand, a student who chooses to attend a political rally supporting a candidate but claims he can’t release his name out of fear of intimidation doesn’t persuade me that it’s the liberals creating, in Jamie’s words, “an environment in which students are meant to keep their opinions to themselves.” And I’d say there’s something twisted in students arguing that professors and students who make strong criticisms of the Republican President, Republican House, or Republican Senate are responsible for othering those students who support the party running our government, or doing some other verb to them which Jamie and others don’t believe in when it’s used to describe the experience of, say, a black female student marginalized by the presence of only one black woman with tenure at Yale. I’m sure that there are situations in which professors overly antagonize students they disagree with on the right, or wrongly let disagreement affect how they grade students on the right, or in which students are rude or dismissive towards students on the right, just as all of these cases are experienced in reverse by students on the left. But that does not oppression make. And if we hear more about the marginalization of conservative students nationally, it may be in part because conservatives have been very effective in using the think tanks and media they dominate the perpetuate the idea of an oppressive liberal university to complement the supposed oppressive liberal media, and to bring accounts of said oppression to light and onto the airwaves.

The account I responded to isn’t even a borderline case. Here the supposed oppression consists simply of the articulation of a viewpoint by a majority of other students, and the appeals of some of those students that he join. It’s ridiculous to claim that as persecution. And it’s that much more ridiculous to compare it to Nazism. Contrary to Jamie’s implication, I’ve never referred here, or in any other venue I know of, to my peers as Nazis. I also haven’t called him a “homophobe” for opposing the activism of Yale Law students. If there are examples to the contrary, let me know. I do believe that the “Don’t Ask, Don’t Tell” policy is soaked in and perpetuates bigotry in a similar manner to the racial segregation of the military not so very long ago.

Errol and Jamie are also disappointed that I and others in what Jamie sees as “Yale’s ever-so-righteous corps of lefty bloggers” haven’t gotten around to critiquing this column. What is there to say? Instead of exploring the divide Bush’s cabinet appointments have demonstrated between descriptive and substantive representation of ethnic minorities, or assessing the destructive impact of Bush’s policy on black communities, or considering the frightening implications of another four years of this foreign policy, she launches an offensive, outrageous, and useless attack on Rice as secretly being a white man. It’s a terrible column. I think we can all agree there.

This is an election we should have won. This is an election we could have won if the candidate had been working as hard, and as smart, as everybody else that was trying to get him elected. We almost won it anyway. It could be that we did. But given Kerry’s unwillingness to wait as long as folks did in line to vote for him before saying, in the name of national unity, that their votes needn’t be counted, we may never know.

I think the most striking find in the exit polls was that significant majorities said they supported Kerry on Iraq but Bush on the war on terror. Funny thing is, main thing Bush has done in the name of stopping terror is ignore Osama bin Laden and create a terrorist playground in Iraq, while refusing necessary funding for homeland security. This says to me that Bush succeeded in making terrorism a question of character rather than of policy. Kerry was certainly savaged by the media in the same way Gore was, while Bush too often got a free pass. But Kerry failed for months to put out a coherent, comprehensible message on Iraq (as on too many other issues), and while voters rightly prefered an alleged flip-flopper to an obvious belly-flopper on the issue, I think he shot a lot of his credibility as a strong leader and he may have lost the rhetorical battle for Commander-in-Chief. His unwillingness to aggressively defend himself, especially from the vile Swift Boat Vet attacks, can’t have helped. What’s tragic, of course, is that Bush has flip-flopped far more, even on whether we can win the war on terror, and that the extent his policy has been consistent, it’s been stubbornly, suicidely dangerous. On this issue, as on every issue, some will argue that Kerry was just too left-wing, which is anything but the truth (same goes for Dukakis, Mondale, Gore). A candidate who consistently opposed the war and articulated a clear vision of what to do once we got there could have fared much better.

Then there’s the cluster of issues the media, in an outrageous surrender to the religious right, insist on calling “moral values” (as if healthcare access isn’t a moral value). Here Kerry got painted as a left-winger while abjectly failing to expose the radical right agenda of his opponent. Most voters are opposed to a constitutional ban on all abortion, but Kerry went three debates without mentioning that it’s in the GOP platform. That, and a ban on gay adoption, which is similarly unpopular. And while he started trying towards the end to adopt values language in expressing his position on these issues and on others, it was too little, too late. An individual may be entitled to privacy about his faith and his convictions, religious or otherwise but a Presidential candidate shouldn’t expect to get too far without speaking convincingly about his beliefs and his feelings (I’m hoping to get a chance to read George Lakoff’s new book on this – maybe Kerry should as well).

This election will provide further few to those who argue that Republicans are a cadre of libertarians and the poor are all social conservatives who get convinced by the GOP to ignore class. The first problem with this argument when folks like Michael Lind articulate it is that it ignores the social liberalism of many in the working class. There are others – like the economic breakdown of voting patterns in 2000, which would make David Brooks’ head explode because the fact is Gore got the bottom three sixths and Bush got the top. But few can argue that a not insignificant number of working class voters in this country consistently vote against their economic interests, and that at least in this election, they have enough votes to swing the result. Here too some will argue the Democrats just have to sell out gay folks and feminists to win back the Reagan Democrats. I think Thomas Frank is much closer to the truth: People organize for control over their lives and their environments through the means that appear possible, and the Democrats’ ongoing retreat from an economic agenda which articulates class inequality has left the Republicans’ politics of class aesthetics (stick it to the wealthy liberals by putting prayer back in schools) as an alternative. For all the flack he got over wording, Howard Dean was speaking to an essential truth when he recognized that working-class southern whites don’t have much to show for decades of voting Republican, and Kerry didn’t make the case nearly well enough. He also seems to have bought into Republicans’ claims that Democrats always spend the last few weeks beating old folks over the head with claims that they’ll privatize social security and forgotten that Republicans, in fact, will privatize social security if they can. So he let too many of them get pulled away to the GOP. Part of the irony of the debate over the tension between the left economic agenda and their social agenda, and whether being labelled with the latter stymies the former, is that as far as public opinion goes, I see much more reason for confidence that we’ll have gained tremendous ground on gay marriage in a generation than that we will have on economic justice. As far as policy goes, the next four years are a terrifying prospect for both, and for most things we value in this country.
