Kingspawn faults my letter for conflating opposition to Roe and opposition to the right to choose. But that distinction is exactly why I wrote

As reported nine years ago in The New Republic, whose editors oppose the Roe v. Wade decision, Casey Sr. was not offered a chance to speak at the convention nominating Bill Clinton because he had refused to endorse Bill Clinton

and not “As reported nine years ago in the anti-choice New Republic.” The point of that clause, though I’ll grant it could have been stated more clearly or simply dropped, was that TNR is on the right of most Democratic voters on the issue of choice, and revels in decrying the Democratic party’s supposed deafness and meanness to voters (read: TNR writers) to its right on issues where TNR is to the right of the party (read: everything but equal marriage). So a repudiation of a story about the Democratic party keeping down Democrats in the right wing of the party means more when it’s written by a magazine that lives for righteous denunciations of the Democrats for keeping down the right wing of the party.

As for Roe v. Wade, it’s certainly not the best argued or compellingly written of our legal decisions, but the majority is right to recognize that autonomy in certain intimate situations and spaces is central to liberty. The equal protection argument (as my brother points out, we don’t mandate that men donate, say, their kidneys, a procedure far less cumbersome than nine months of pregnancy, to save what we can all agree to be living human beings in need of organs) absolutely should have been made in Roe as well, and the Casey majority’s time would have been much better spent expounding that than floating a stare decisis argument that privileges the legitimacy of the court over the rightness of its jurisprudence.

A letter I sent a few days ago:

To the Editor:

I was disappointed to see the Times Magazine (“The Believer,” May 22, 2005) repeat the long-discredited claim that my state’s late Governor Bob Casey “was barred from speaking at the 1992 Democratic National Convention because of his antiabortion views.” As reported nine years ago in The New Republic, whose editors oppose the Roe v. Wade decision, Casey Sr. was not offered a chance to speak at the convention nominating Bill Clinton because he had refused to endorse Bill Clinton. For Democrats to put Casey on the program in 1992 would have made no more sense than for Republicans to include Senator Lincoln Chafee, who refused to endorse George W. Bush for re-election, among the slew of ostensible “moderates” in the spotlight at their convention last year. Democrats who oppose a woman’s fundamental right to choose – including the party’s Senate Leader – are all too prominent, not only in the party’s speaking programs, but in its leadership. And contrary to the myth unfortunately revived this week in the New York Times, the party should be faulted not for alleged hostility to anti-choice voters but for its too-frequent willingness to compromise key values rather than finding more effective ways of making the case for them to those Americans we have not yet persuaded. The party leadership has unfortunately repeated this mistake by throwing its full weight behind the anti-choice Bob Casey Jr. in his Senate primary against Chuck Pennacchio, an inspired progressive better poised to offer Pennsylvanians a real alternative to the radical right-wing record of Rick Santorum.

Bad news for those of us who’ve been rooting for new leadership at the AFL-CIO, as the UAW, one of the crucial remaining swing votes, yesterday endorsed John Sweeney for another term. This leaves little chance of a change in leadership this time around, as Thomas Edsall writes, and is prompting a shift in focus to the next choice the reformers have to make – should they stay or should they go:

While Sweeney, 71, now appears certain to win, the nation’s largest union, the Service Employees International Union, is more likely to follow through on threats to bolt from the AFL-CIO. “The challenge here is to make sure we have a labor movement that can change people’s lives,” said SEIU President Andrew L. Stern, noting that all of his union’s locals are voting on a proposal that would authorize the union to sever its ties to the labor federation…The dissident unions, calling themselves the “Change to Win” coalition, had been counting on the UAW to give them new momentum, and lift the collective membership of their unions to well over 5 million. There are about 13 million members in the 58 unions that make up the AFL-CIO, so it takes unions with a total of 6.5 million members or more to win a leadership fight. At the moment, the dissident unions have just under 5 million members. Stern said beating Sweeney had been a long-shot proposition from the beginning. “It’s always been hard to imagine defeating an incumbent leader,” Stern said. “John Sweeney has probably always had the votes.” Unite Here President John Wilhelm, who was widely viewed as the most likely person to run against Sweeney, contends that winning majority support for restructuring will precede any leadership change. He said he has spent his “entire life in the House of Labor,” but he did not rule out joining Stern and leaving the AFL-CIO.

This a sad development for Americann workers, and it’s a shame that for now, an AFL-CIO guided by a reformist vision of what was the New Unity Partnership and by more inspired leadership has become a much more distant possibility. Hopefully John Sweeney will continue to feel and respond to the pressure to build a federation which leads its member unions to revived power by prioritizing aggressive organizing facilitating effective cooperation, and encouraging tactics which work.

The AFL-CIO, unfortunately, has not been working for a long time, in part because too often its approach has looked more like the narrow approach of the old AFL than the agressive broad-based approach of the CIO. There’s plenty to fear about a potential breakaway from the federation. The kind of union raiding which the reformers have identified as a challenge to labor’s effectiveness could become uglier were some or all of these unions to move outside of the structure of the AFL-CIO. And the red-baiting and purging of early post-war period can be pinned in part on the division between the AFL and the CIO. But that said, the same competition between the federations also sparked a great deal of tremendous organizing which, if not for the CIO’s existence as an independent organization, might very well never have taken place. Unions like SEIU and UNITE HERE have a model which is working, though certainly imperfectly, and it’s a model which has has achieved some impressive successes despite the failure of the federation to effectively serve the functions they’ve rightfully called for it to execute. If pulling out means a renewed ability to marshall resources for maximum efficacy in organizing, to build stronger coalitions with other progressive organizations with shared worldview, to more effectively hold politicians accountable (good cop, bad cop, et al), and to press the AFL-CIO from the outside to reform, it could be more than worthwhile.

The narrow lense through which this has all been read in the Times and Post and such, unfortunately, is “Labor = Democratic Turnout Machine” and ergo “Division in labor = peril for Democrats.” This slant is both short-sighted and wrong-headed. What the Democratic party needs, and should be doing much more to foster, is a reversal of the decline in American union membership. Any change that leads to more effective organizing broadens the Democratic constituency. Internal debate about how to make that happen is certainly healthy; if a split is effective in making union membership a reality for the millions of Americans who want it, then that spells great things for the Democratic party. If it can’t accomplish that, then it’s already a terrible move. But there’s no reason to assume that two federations would be fatally less effective at political turnout than one. The Democratic politicians who really have a reason to be afraid are the ones coasting on their partisan affiliation without keeping promises to American workers. If these newspapers are committed to assessing what a split would mean for the Democratic party, first they’ll need to engage the conversation on what it means for the labor movement.

I have to admit that Howard Dean’s email today about the pace of fundraising, and what the DNC is doing with that money, got me more excited than I expected. Hearing that the priority is hiring organizers and getting them on the ground in states like Kansas is tremendously encouraging. I don’t recall ever hearing anything like this from Terry McAuliffe, which doesn’t really surprise me, but it’s the right direction to be going. Building power on the ground, and making a long-term committment to organizing is the only way the party is going to recover, and it recognizes a central problem that we had in the last election. The Republicans had people in neighborhoods, and we had MoveOn-organized phoneathons from solid blue states to swing states. I’ve become progressively disillusioned with MoveOn, partially because of the way they spin things (I was especially frustrated with their perception of the fillibuster “victory,” and the lame Star Wars-based ad), and because I thought, even at the time, that it was glaringly obvious that wasting a lot of time, energy, and money on phonebanks was not a winning strategy. As sincere as all of those efforts were, scripts do not convince people to get out and vote particularly well, and can never be subtle enough to make people switch their votes in large numbers.

What organizers can do is far different. There are, and will continue to be, huge limitations to organizers who come in from the outside to organize communities they aren’t from. But they can identify people who have power or contacts and aren’t using them, or aren’t using them effectively enough. They can encourage people who want to get involved to make the jump by providing them with opportunities. There’s a notable passage in Grassroots, a pretty good book about the ’88 New Hampshire primary, where one veteran of ’84 talks about how she considers her box of file cards on her contacts the treasure she can bring to a campaign. The first priority of organizers should be to find people like these, whether they are leaders in quilting and book clubs or in local party organizations, and train them to be leaders. The Democrats will succeed if our new organizers make themselves obsolete. I’d like to think that this can happen; I am wary of what happened to Dean’s “Perfect Storm” in Iowa. In any case, this is an approach very different than purly raising money for ad buys and long distance phonebanks. I’m glad that something different is happening in the party; we needed both the fresh air and the reality check.

So it turns out to be a compromise on judges after all. Hard to know just how to read it, given that with freedom for Democrats to filibuster under “extraordinary circumstances” and for Republicans to nuke if “continuing commitments made in this agreement” are abridged, all it resolves for good is that Janice Rogers Brown, William Pryer, and Priscilla Owen will soon be Circuit Court Judges and William Myers and Henry Saad won’t be. But given that the Democrats’ position on this has, for better or worse (you can guess where I come down on that one), all along been one of extreme willingness to compromise (“We gave you the judge who thinks men should dominate their wives, but do you really need the one who thinks God has veto power over the constitution”), almost any compromise would have been a political victory for the Democrats. Not as big a victory as the one I suspect we could have had tomorrow (in part because I trust John McCain’s political instincts more than, say, Joe Lieberman’s). As compromises go, the word a few days ago was that the major sticking point was GOP resistance to language like this:

We believe that, under Article II, Section 2, of the United States Constitution, the word “Advice” speaks to consultation between the Senate and the President with regard to the use of the President’s power to make nominations. We encourage the Executive branch of government to consult with members of the Senate, both Democratic and Republican, prior to submitting a judicial nomination to the Senate for consideration.

So the Dems at least got something out of the negotiations. Today we saw a few Republican Senators buck the Senate leadership and the Senate buck the unilateral impulses of the White House. That counts for something. And the reason it happened is because public opinion has turned rather sharply against the Bush team and their exercise of their ostensible mandate. That’s a trend which should have implications which last much longer than this agreement. But only if the Democrats capitalize on it with a robust and aggressive vision. I’d say cutting this deal was a poor move, but those saying that the party had been taking a firm and principled stand which it undercut tonight forget that when it comes to steadfast refusal to let through extremist unqualified judges, the ship had sailed on that one – and driving it were Randians, theocrats, and Randian-theocrats who have now safely arrived in a court near you. The Democrats’ repreated invocation of outrageous nominees they’d let though, rather than making them seem eminently reasonable, just made them look sort of silly.

Speaking of the future, anyone who still thinks John McCain – in whose office the compromise was apparently signed – isn’t running for President has another think coming. Same goes for anyone arguing that he does whatever’s right regardless of politics. As for Bill Frist, I’m sure he’ll do well on the lecture circuit. Or at least, he has a better shot at it than at a serious run for the GOP nomination. Good news for him: washed up right-wing speakers, unlike sitting Senators, aren’t expected to go into inner cities where they have to worry about being stabbed to death by children of color with pencils. Now, back to spanish conjugations for me.

Trent Lott just livened up what’s been a not overly riveting series of Senate floor speeches on judicial nominations by accusing Democrats with concerns about extremists nominees of having turned the Senate “into a torture chamber.” Given the honorable Senator from Mississippi’s enthusiastic defense of the administration when it came to actual torture, one can only assume that he indeed means that the Senate has caused pain “of an intensity akin to that which accompanies serious physical injury such as death or organ failure” to Priscilla Owen and Janice Rogers Brown.

“Restoring the American Dream: Building a 21st Century Labor Movement that Can Win,” the platform released by UNITE HERE, SEIU, the Laborers, and the Teamsters on Monday, is on-line here. Its Agenda for Worker Strength has five points, the first of which, “Uniting Workers for Economic Strength,” articulates the structural proposals which have been at the center of the controversy over the future of the AFL-CIO. It calls for the federation to:

Use incentives to focus unions on uniting workers in core industries.More of the national labor movement’s resources must be directly devoted to the task of bringing millions of new workers into the labor movement. The AFL-CIO budget must be used to create incentives for unions to increase their organizing and focus on uniting workers in their core industries in order to maintain and build bargaining power. We believe that half of what unions now pay to the AFL-CIO should be rebated to unions that have a strategic plan and commitment to organizing in their core industries based on the formula outlined in the Teamster proposal.

Actively support mergers that unite workers by industry. Many AFL-CIO affiliates do not have the resources or strength or effectively take on large employers that are driving standards in their industries or to help workers organize on a large enough scale in their industries…The AFL-CIO should play an active and direct role in working with affiliated unions to facilitate mergers – subject to approval by the affected members – that lead to increased power for workers in the same or complimentary industries…

As this platform recognizes, the responsibility of a single national labor federation, if we are to have one in this country, is to grow the labor movement by protecting the right to organize and providing resources and facilitating coordination for organizing. In an era of declining union density and increasing corporate consolidation, coordination within industries is crucial to turning the tide, and mergers – when they are strategically savvy and democratically supported – are a powerful tool for building power and solidarity. And most of all, as John Sweeney himself has repeated over the past decade, the straits in which working Americans find themselves today make it imperative to organize or die. The unions bringing forward this proposal are right to recognize that spurring organizing requires more than rhetorical leadership from the AFL-CIO. The reason they represent a significant fraction of the membership of the federation is that they have prioritized an aggressive organizing program over the past decade, and in so doing have realized the right to collective bargaining for millions out of the more than half of American workers who say in polls that they want union representation at a time when only one in twelve in the private sector has it. Because union membership is a source of greater strength when greater numbers of workers are in unions, it is not only justifiable but crucial for a federation funded and supported by fifty-some internationals to use its resources to push each of those unions to grow. Remitting a portion of those dues to those unions committed to spending money to directly grow the density of the movement is directly in the service of the broader movement. If the AFL-CIO is kept from aggressively push greater organizing and coordinated action, it risks being reduced over time to little more than an occasional media and turnout apparatus of decreasing usefulness. The document continues:

Strategically leverage labor’s existing bases of industry strength…It means identifying lead and dominant unions by sector, industry, employer, market, and where appropriate, craft, along with the responsibilities that go with it. It means that industry or area bargaining standards need to be made central to the inter-union dispute process and central to labor’s efforts to focus resources…rules must be updated and revised to reflect the pressing need for organized labor to deter the “race to the bottom” caused by employers seeking to use one affiliate as a means of protection from another, and to encourage unions to devote precious resources to building power in core industries and coordinate bargaining. Where multiple unions have members in the same industry, industry in a market, or employer, the AFL-CIO will facilitate coordinated bargaining. Affiliates undercutting standards should suffer penalties.

I’m not sure yet what to make of the assignment of dominant unions in each sector, but the need for clear and unyielding standards in bargaining is inarguable. As long as weaker unions cut deals with employers to keep out stronger unions, the labor movement is shooting itself in the back and it is those workers who most need effective representation who suffer. Critics of the New Unity Partnership are right to remind us that the absolute right of a worker to join a union of her choosing is not to be compromised. No one wants to see workers shoehorned into pre-selected unions based on negotiations in which they have no part. But the fundamental economic freedom of union representation is not served when weak unions take on the role of the company unions of the pre-Wagner era and push out internationals which threaten an employer because they have the power to win real gains. The only way I can see to empower workers to organize and to win is through the formation and standards and the facilitation of negotiation, and the reformers are right to identify a role for the AFL-CIO, as a voluntary union federation, to play here in maximizing the effectiveness of its member unions in growing and serving the ranks of its member workers. Too often, this issue is discussed as a matter of big unions versus small unions. But the assumptions that small unions are always more democratic and that that big unions are always more effective are both misguided, and neither is borne out by history. Much more salient is the division between those unions which prioritize organizing and industrial democracy and those which do not. Somewhat less controversial is the next proposal:

Make the AFL-CIO the strategic center for a permanent campaign to take on powerful anti-worker employers and help workers unite their strength in new growth sectors.…Well-funded, movement-wide campaigns are required to make low-road employer respect their workers’ freedom to form unions…We support the creation of a dedicated fund of $25 million out of the current AFL-CIO to finance large, multi-union movement-wide campaigns directed at reversing the Wal-Marting of our jobs and out communities by large low-road employers.

Fortunately, after years of unsuccessful and largely unnoticed and uninspiring organizing attempts by the UFCW at Wal-Mart, there’s a growing awareness that the viral expansion of Wal-Mart and its noxious business model will mean diminishing returns for the entire movement until we take it on head-on, and that organizing Wal-Mart represents a momentous challenge which cannot be overcome by a single union alone. As John Wilhelm wrote to John Sweeney last year, however the November election went there would have been no greater priority for the American labor movement in its wake than winning a robust right to organize for millions of Wal-Mart workers. As we saw in the supermarket strikes in LA, as long as Wal-Mart pushes forward a race to the bottom at an unprecedented rate, all working people lose. And it will take the commitment of the whole federation to reverse that trend.

Make growth and worker power our political focus…To empower workers politically we must have a growth agenda to build larger, stronger and more effective workplace organizations. Increased political spending without a program for growth will not lead to either increased power for workers in the workplace or in politics…Our program must be workplace-centered, worker-oriented, and independent of any party or candidate. Our purpose is to be the voice of workers in the political process, not the voice of politicians or parties to the workers…The AFL-CIO’s political program at the local, state, and national levels should have as its highest priority encouraging public officials to actively support workers who are trying to form unions, as well as to support the maintenance and growth of union jobs…those politicians of either party who support the union-busting agenda of the Right to Work Committee, the Associated Builders and Contractors, or any other similar organization should face rebuke from all unions affiliated with the AFL-CIO regardless of their stand on other issues. The AFL-CIO needs to develop a strategic growth and political plan focused on critical swing states that will make the difference in changing the direction of our nation, and to which state and local bodies and affiliates are held accountable…an increase in union density in the State of Ohio, for example, from 16% to 26% would have put John Kerry in the White House.

This document is absolutely right to recognize the failures of the AFL-CIO in holding accountable Democrats who cast anti-labor votes, in forcing the right to organize onto the national political agenda, and in using the political system to protect and further workers’ rights. I think the problem has much more to do with the federation’s treatment of anti-labor Democrats than of pro-labor Republicans – in fact I’d say too often labor has bent over backwards to bestow the pro-labor Republican label for the appearance of a bipartisan pro-labor consensus of the kind we have yet to create. And the reformers are right that a resurgence in labor’s political clout cannot come without a resurgence of union organizing. Here labor and the Democrats should have a shared interest in creating more union members, given that union membership is the only thing that makes white men with guns who go to church vote Democratic; would that the Democrats put as much effort into trying to multiply the ranks of union members as the Republicans are into trying to create more investors. Putting the right to organize front and center would help Democrats doubly by creating more union members and by giving them more reason to vote Democratic; this platform attests to the ways the AFL-CIO has to go in pushing for politicians to do so. The legal right to organize cannot itself be labor’s entire political agenda however; while this paragraph almost reads as if it is, the platform later devotes entire sections to coalition-building around healthcare and global trade. The line later on refering to “social issues” as outside of the purview of labor is as unsettling as it is intentionally ambiguous. It certainly doesn’t represent the approach that’s yielded success for SEIU and UNITE HERE over the past decade. A path to citizenship for undocumented immigrants and freedom from discrimination for women, workers of color, and queer workers, are fundamental issues of workers’ rights, and any labor federation which shies away from them does so to its own detriment and that of this country’s most marginalized workers. A recognition of the urgency of broadening the movement is more clear in the sections on diversity within the AFL-CIO and international solidarity.

New Standards of Accountability and Governance…If labor as a whole is to grow the AFL-CIO must be the movement’s strategic growth center…democratic change requires the creation of a streamlined Executive Committee comprised of the largest unions that represent most AFL-CIO members and are responsible for uniting workers in the major sectors of the economy, with several additional rotating seats to ensure diversity…Financial and organizational accountability and openness must be the operating principal of a new AFL-CIO. Ongoing senior level staff meetings between unions on issues of AFL-CIO policy must take place between meetings of principals…The AFL-CIO must establish and enforce standards in such areas as bargaining, strategic industry plans and results; political fundraising and participation by members and their families, workplace organization, among others.

I’m not sure what structural arrangement best serves the ends of openness and representativeness within the AFL-CIO. But inter-union dialogue is certainly a must, as is transparency in decision-making and accountability in producing results. This accountability must apply both to the federation’s leadership and to its member unions. The AFL-CIO is, after all, a voluntary compact, and affiliation should signify a commitment to organizing and building the movement.

These proposals, all the more so when taken together with the other four points of the platform (focused on representation, strategic use of union money and purchasing power, global solidarity, and healthcare and retirement security), represent a blue-print with at least the potential to bring real change to a federation in deep need of it. I support its broad vision, including the final point of that first section:

Leadership Committed to Building a Movement that Can Win. The AFL-CIO needs leadership that is committed to the kind of fundamental restructuring of the federation that we are proposing.

Guest-blogging over at Ezra Klein’s site (mazal tov!), Dan Munz is suggesting the possibility of a Mfume v. Steele Maryland Senate race as a chance for Democrats to take on and shoot down the GOP argument that Democrats take Black voters for granted. I think Dan’s absolutely right that a concerted, rigorous response from the Democrats is long overdue. I’d say part of the problem, though, is that the Democratic party establishment does indeed take Black voters for granted, in much the same way it takes most chunks of the party’s base – union voters for example – for granted, and in a way the GOP simply doesn’t treat it’s own base. Wherever one comes down on the Katha Pollitt vs. Thomas Frank debate on whether or not evangelicals who vote Republican to erode reproductive choice get their money’s worth, the Republican party makes a serious, year-in and year-out campaign of selling itself to its base while the Democratic party more often treats its base like the weird uncle who always shows up drunk to Thanksgiving (the pundits who complain about how short-sighted the NAACP is for wanting Democrats to swing by when the NRA doesn’t ask the same of Republicans might spend their energies better considering why the parties’ records might leave NAACP members with more concerns about how loyal the candidates they vote for will be).

Granted, President Bush’s appeal to Black voters to better defend their interests by spreading their votes more evenly is pure condescending silliness (I’d like to see him apply the same logic to, say, Enron executives: “As long as you all keep voting for us, what incentive do we have to keep giving you those invisible handjobs?”). More fundamentally, of course, the problem with Bush’s case is the idea that Democrats brazenly push forward with liberal policies they know are bad for their Black constituents. The reality, unfortunately, is that Democrats tend not to do nearly enough brazenly pushing forward with much of anything. The problem isn’t that the Democrats are too far left; the problem (I know I know, I’m the guy with the hammer, and look – it’s another nail!) is that the Democrats are failing Black constituents, as well as White ones, by not offering a program or an approach that’s progressive enough. The Republicans are hard at work rolling back the gains of the Civil Rights Movement, while the Democrats, even when they had branches of government of work from, have shown precious little initiative in extending them. Republican national candidates have mastered the art of the coded appeal to racist voters, while Democratic candidates remain anxious about looking like they’re trying too hard to attract Black voters (or, god forbid, “dependent” on them).

What might an aggressive Civil Rights agenda look like? An aggressive push for comprehensive voting reform, including a constitutional individual right to vote, uniform standards for ballot access and machinery, paper trails, and abolition of felon voter disenfranchisement. An aggressive push to transform the crimminal justice system into one which takes seriously the equal protection rights of Americans of different races and classes and which rehabilitates rather than stigmatizing those who pass through it. An aggressive push for drastically increased investment in education at all levels. An aggressive push to raise the minimum wage and strengthen the right to organize. An aggressive push to strengthen anti-discrimination legislation. An aggressive push for universal health care. An aggressive push for real affordable housing. That would be a start. Some of these areas have attained greater prominence in the Democratic party’s agenda of late, to a lot of people’s credit; others are still waiting. As Dr. King observed not long before death, the reforms that will achieve real progress in Civil Rights will cost billions. All of these reforms are changes in which Americans of all races have a stake, and which could be achieved such that the great majority of Americans would benefit. And this summer in Florida, I had infinitely more conversations with African-Americans reluctant to register to vote because of the party’s silence or meekness on continuing the progressive work of the Civil Rights movement than because they wanted school vouchers or felt demeaned by affirmative action or were scared of gay people.

So yes, the Democrats need better answers to the Republicans’ cynical appeals to Black voters, and they need candidates who are better at articulating them. But any message which boils down to “No, Democrats don’t take [you/us] for granted, they care about [you/us] very much” is doomed to fail. What the Democrats need, as Al Sharpton put it several times during the Presidential debates, is candidates who can give the donkey the kick it needs (not something Sharpton accomplished a great deal at). And the most powerful kicks tend not to come from candidates at all. As much as Dan talks about a “traditional” relationship between Democrats and Black voters, the tradition is fundamentally one of tension and contestation, one which envelops both Jack Kennedy’s supportive call to Coretta Scott King and Bobby Kennedy’s call to John Lewis pleading him to cancel the freedom rides. As with so many other cases, the job facing the leaders of the Democratic party is as much about improving its record as defending it.

Nathan’s had a series of good posts recently the kind of social security reform we should all be behind: taking on the regressive income cap on the payroll tax so that Bill Gates no longer can finish earning his payroll contribution for the year long before he wakes up on New Year’s Day.  Payroll taxes are a huge chunk of the tax contributions made by low income Americans in the post-Reagan era, and that a CEO making millions a year pays no more in absolute dollars than an employee making $90,000 is an outrage we should be hearing much more about from the Democratic side of the aisle.  It’s time they did, because it would be good for the country and as Nathan observes, it would be good politics as well:

The argument against talking about a deal is reasonable as short-term politics: when your opposition is stumbling, let them fall on their feet. But that does buy the idea that there’s nothing wrong with Social Security that needs fixing. No, there is no funding crisis, but the reality is that social security is fundamentally a regressive tax…This has been a problem for decades and progressives never took proactive action to improve the situation. Which opened the door for this rightwing attack in the first place…We know that House Republicans won’t agree to elminating the payroll tax cap, so there is no danger that proposing it as a reform will be met with any real negotiation on the issue. But we can slam the conservatives for supporting such a regressive policy.

And since progressives don’t believe there is a crisis, we don’t think there needs to be any new revenue raised TODAY, so any rise in revenue from eliminating the payroll tax cap should be matched with an overall cut in payroll tax rates paid by average workers– probably equivalent to saving them 2-3% of their income. Yes, Dems should be proposing a TAX CUT! You want wedge politics, you’ve got it. Many progressives have pushed for raising the cap to cut payroll taxes over the years (see here), and we should not abandon pushing the idea just as national attention is on social security. Progressives are not going to revive their national fortunes by only playing defense and defending the status quo. They need to play political jujitsu to take ideas put on the national agenda by Bush and use that debate as a vehicle for selling a vision of better, more progressive alternatives. Otherwise, we may win a few rearguard fights, but we won’t move forward in building broader support for the changes WE want.

And as Nathan further notes, eliminating the cap will keep social security solvent for most of a century, while gaining many more voters than it would lost. The polling bears it out as well…

Donnie Fowler’s success in getting the support of a narrow plurality of the Executive Committee of the Association of State Democratic Chairs in his run for DNC Chair proved pyrhic today when the full membership took its own vote and Howard Dean beat Fowler 56 to 21, prompting the ASDC to endorse Dean and Wellington Webb to drop out and endorse Dean as well:

Webb, a former three-term Denver mayor, pulled out of contention immediately after an influential group of state Democratic Party chairpeople overwhelming supported Dean, a 2004 presidential candidate who promises to rally the “Democratic wing of the Democratic Party.” Also today, Colorado Democratic Chairman Chris Gates backed Dean after stumping for Webb for more than a month. “Howard Dean has been a thoughtful advocate for progressive change, both as governor of Vermont and as a candidate for president. And I think he’ll make a great national party chair,” Gates said.

Kos loses it:

Once upon a time, party officials feared NARAL, they feared the unions, they feared the Sierra Club, they feared trial lawyers, they feared NOW, they feared the NAACP, they feared Latino groups, and so on. For the first time, it looks like they’re starting to fear people, not special interest groups. We’re growing up as a party.

Wal-Mart is a special interest because it leverages a tremendous amount of money and power to serve narrow ends which benefit a tiny constituency of plutocrats and wreak havoc on the lives of most Americans.

Unions pool and leverage the power of their members and their willingness to engage in organizing and collective action to secure justice for themselves and for millions of working Americans. There is no comparison.

To say that bevy (however large) of bloggers (folks who are disproportionately whiter, richer, and maler than America, let alone the Democratic party) are real people in a way that organized workers, organized environmentalists, organized women, and organized people of color are none is outrageous.

Over at The New Republic, Hillary Clinton is winning accolades from Michelle Cottle and Andrew Sullivan for her new rhetoric on abortion last week. Like Clinton herself, they’re each partially right.

Cottle takes on Jim Wallis of Sojourners and others for trying to win the “moral values” debate for Democrats by shifting it onto economic turf. She’s right to argue that responding to the heartfelt opposition of all too many working class Republicans to the Democrats’ stances on abortion and other so-called “social issues” with a sleight-of-hand is both insulting and ineffective. The Democrats do indeed need to win the values debate on the “social turf.” But, contra Cottle, a winning strategy for the Democrats will also depend on broadening the popular conception of moral politics to include the economic exploitation and persistent poverty of millions of Americans. Cottle should know better than to take on face value the idea that so-called “values voters” simply could care less about children without healthcare. She completely overlooks the extent to which, in the absence of a real discussion by Democrats of America’s savage inequalities. Republicans have been able to successfully repackage “social issues” as class grievances against liberal elites and activist judges. It’s not surprising that those who want Democrats to change the topic and trounce the GOP on economic moral issues and those who want them to change the message and trounce the GOP on social moral issues each see the other standing in the way of progress. But a winning strategy will have to do both.

Sullivan, like Cottle, writes with the stated intention of helping Democrats win on abortion. And parts of the approach for which he credits Clinton are indeed good moves. Certainly, Democratic politicians and activists should recognize the difficulty and sadness with which many women approach the choice to have an abortion (Sullivan, like most pundits, drastically exaggerates the extent to which this is not already the case). And absolutely, Democratic politicians and activists should frame access to all forms of contraception in all situations as “the surest way to prevent” abortions (nothing so new here either). As for demonstrating respect for one’s opponents, I don’t think many are arguing that the Democrats should demonstrate intentional disrespect for those who disagree on abortion.

But what those on both sides of this debate want, more than respect, is to win. And while Sullivan insists (in a strange turn of phrase) that “Democrats can still be and almost certainly should be for the right to legal abortion,” readers can be excused for coming away with a mixed message. Sullivan follows a long line of pundits and reporters in conflating changes in discourse on abortion with changes in policy. Seemingly intentional ambiguity radiates from Sullivan’s insistence that

One reason that John Kerry had such a hard time reaching people who have moral qualms about abortion was his record: an almost relentless defense of abortion rights – even for third trimester unborn children – with no emphasis on the moral costs to all of us of such a callous disregard of human dignity. You cannot have such a record and then hope to convince others that you care about the sanctity of life.

One could read such a graph to mean that Kerry could have won the abortion debate if only he were on record mourning the “moral costs.” But it’s not clear why one would. A more intuitive reading would be: To win over “pro-life” voters, Democrats should cast more “pro-life” votes. Otherwise, how are we to understand Sullivan’s criticism of Kerry for being “almost relentless” in supporting the right to choose. Sullivan isn’t so much offering ideas on how to win the debate over abortion as urging a partial surrender.

More specifically, Sullivan lauds Clinton’s support for abstinence-only education as good politics, despite the preponderance of evidence that diverting dollars from sex ed to abstinence ed will lead to more unprotected sex and therefore more abortions. And Sullivan urges Democrats to back candidates like Bob Casey in Democratic primaries specifically because they oppose the party’s position on abortion rights. He pushes this plan – that Democrats essentially should sell their position by working against candidates who support it – as a corrective to a mythical “fatwa” against such politicians in the Democratic party. Those who believe such a fatwa exists may still be under the mistaken impression that Casey’s father was denied the chance the speak at the convention nominating Bill Clinton because he opposed abortion and not because Casey had announced he would be voting against Bill Clinton. Either that, or they’re willing to suggest with a straight face, as Sullivan does, that for the GOP to have a pro-choice second-in-command at the RNC while the Democratic party has an anti-choice Senate Minority Leader demonstrates that “the Republicans are more obviously tolerant of dissent than Democrats.”

Finally, Sullivan wants Democrats to tone down the rhetoric about women’s rights and instead frame abortion as killing and abortion rights as a way to avert more gruesome killing. Instead of “reproductive rights,” Sullivan argues, Democrats should talk about a decision through which “one soul is destroyed and another wounded.” But while talking about abortion as a “sad, even tragic choice” for the mother may help make the case, arguing that it’s a tragedy for “unborn children” won’t. Either a woman is a constitutionally-protected person with a fetus inside of her, or a fetus is a constitutionally-protected person with a womb attached. If Democrats frame abortion as killing, as Sullivan does, they will only increase support for banning abortion (and for the dissolution of the Democratic party). This too, is not a new idea. Neither is it a good one.
